Hold Harmless Agreement
1. Agreement to Participate: I, _______________________, hereby acknowledge that I am voluntarily participating in activities at the Mission Community Woodshop, hereinafter referred to as the "Woodshop," located at 20 Clinton Park in San Francisco. I understand that participating in woodworking activities involves inherent risks and dangers.
2. Assumption of Risk: I understand and acknowledge that woodworking activities may involve the use of sharp tools, heavy machinery, and other equipment that may cause injury. I voluntarily assume all risks, known or unknown, associated with my participation in woodworking activities at the Woodshop.
3. Release of Liability: In consideration of being permitted to use the facilities, tools, and equipment at the Woodshop, I hereby release, discharge, and hold harmless the Woodshop, its owners, employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or my property while participating in woodworking activities at the Woodshop.
4. Indemnification: I agree to indemnify and hold harmless the Woodshop, its owners, employees, agents, and representatives from any and all claims, including legal fees, arising out of or related to my participation in woodworking activities at the Woodshop. This indemnification shall include, but not be limited to, claims arising from my negligence, misuse of equipment, or violation of Woodshop rules and regulations.
5. Acknowledgment of Safety Guidelines: I acknowledge that I have received, read, and understood all safety guidelines, rules, and regulations provided by the Woodshop. I agree to abide by these guidelines and follow all instructions provided by Woodshop staff while using the facilities, tools, and equipment.
6. Emergency Medical Treatment: In the event of an emergency, I authorize the Woodshop staff to seek emergency medical treatment on my behalf if deemed necessary. I understand that the Woodshop staff will make reasonable efforts to contact emergency services and notify my emergency contacts.
7. Governing Law: This agreement shall be governed by and construed in accordance with the laws of California. Any dispute arising under or related to this agreement shall be resolved exclusively in the courts of California.
8. Severability: If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
9. Injury: Working in a woodshop has inherent risks and we do all we can to minimize these risks. Safety should be prioritized above all else here; if you don't feel safe at any point during the class, please approach a teacher for assistance and support. Also, in the event that there is an injury, please alert the teacher immediately. There is no shame in being injured -- it can happen to anyone.I have read and understand this Hold Harmless Agreement, and I voluntarily agree to its terms and conditions.
Photo Release
I hereby grant Mission Community Woodshop permission to use my likeness in a photograph, video, or other digital media in any and all of its publications, including web-based publications and social media, without payment or other consideration. I understand and agree that these photos will become the property of Mission Community Woodshop. (We will only use your image to promote the shop and the work we do or to share information with the general public.)
